Developments at OPM: Guidance on Executive Order

Developments at OPM: On October 10, 2018, the Office of Personnel Management (OPM) issued Interpretive Guidance on implementation of Section 5 of Executive Order 13,839.  OPM's Interpretive Guidance clarifies some aspects of how Section 5--the provision limiting modification of federal personnel records in settlement--should be applied.

Developments at OPM: Proposed Rule on Administrative Leave

Developments at OPM:  On July 13, 2017, the Office of Personnel Management (OPM) published a Proposed Rule in the Federal Register (82 Fed.Reg. 32,263-32,281).  The Proposed Rule implements recent legislation modifying the legal structure for administrative leave for federal employees. 

Developments at OPM: Proposed "Ban the Box" Rule

Developments at OPM:  On May 2, 2016, the Office of Personnel Management (OPM) published a Proposed Rule with Request for Comments in the Federal Register, 81 Fed.Reg. 26,173-26,175.  This proposed rule is part of the Administration's larger "ban the box" initiative to avoid deterring applicants with criminal records or negative credit history from applying for federal positions. 

Developments at OPM: Final Rule on National Security Positions

Developments at OPM:  On June 5, 2015, the U.S. Office of Personnel Management (OPM) and the Office of the Director of National Intelligence (ODNI) jointly published a Final Rule in the Federal Register (80 Fed.Reg. 32,244-32,265).  The Final Rule implemented updated regulations for agencies to designate positions as "national security positions"--and potentially excluding  affected positions from Merit Systems Protection Board (MSPB) appeal rights.  The Final Rule is effective July 6, 2015.

Developments at OPM: Guide on Protections for LGBT Federal Employees

Developments at OPM:  On June 3, 2015, the U.S. Office of Special Counsel (OSC), the U.S. Office of Personnel Management (OPM), the Equal Employment Opportunity Commission (EEOC) and the Merit Systems Protection Board (MSPB) jointly issued a new report, "Addressing Sexual Orientation and Gender Identity Discrimination in Federal Civilian Employment  A Guide to Employment Rights, Protections and Responsibilities."  This Guide summarizes the great extent to which the EEOC and OSC have expanded to cover sexual orientation and gender identity discrimination claims during the past 10 years.

Developments at OPM: Final Rule on Phased Retirement

Developments at OPM: The Office of Personnel Management (OPM) published a Final Rule in the August 8, 2014 edition of the Federal Register (79 Fed.Reg. 46,608-46,638). The Final Rule contains OPM's final regulations for implementing the phased retirement created by Section 100121 of Pub.L. 112-141, as previously analyzed in this blog. The effective date for the rule is November 6, 2014. 

Developments at OPM: Proposed Rule on Same-Sex Marriage and FMLA

Developments at OPM:  On June 23, 2014, the Office of Personnel Management (OPM) issued a Proposed Rule in the Federal Register (79 Fed. Reg. 35,497-35,498).  OPM is proposing to revise the regulations governing federal-sector Family and Medical Leave Act (FMLA) leave to extend coverage to same-sex spouses of federal employees.  Comments on the Proposed Rule are due August 22, 2014.

Developments at OPM: Final Rule for Hatch Act Amendments

Developments at OPM:  On Monday, May 5, 2014, the Office of Personnel Management (OPM) published a final rule in the Federal Register implementing the 2012 Hatch Act amendments.  The Final Rule can be found at 79 Fed.Reg. 25,483-25,486.  The Hatch Act amendments were analyzed previously in this blog.  The Final Rule comes into effect June 4, 2014. 

Developments at OPM: Proposed Rule For Career Status

Developments at OPM: The Office of Personnel Management (OPM) published a Proposed Rule in the January 6, 2014, edition of the Federal Register (79 Fed.Reg. 610-613) which proposes to ease the rules for federal employees to reach 'career' status. Comments on this Proposed Rule must be received by OPM by March 7, 2014.

Developments at OPM: Proposed New Rule for Religious Accommodation

Developments at OPM: The Office of Personnel Management (OPM) published a Proposed Rule in the August 30, 2013 edition of the Federal Register (78 Fed.Reg. 53,695-53,700) for religious accommodations for federal employees. Comments on this Proposed Rule must be received by OPM by October 29, 2013.
