Developments at the MSPB: FY 2016 Annual Performance Report

Developments at the MSPB: On May 23, 2017, the Merit Systems Protection Board (MSPB) issued its annual performance report for FY 2016. The report discussed the current status of the MSPB's caseload of furlough appeals, its overall case processing in FY 2016, and specific case statistics for whistleblower reprisal cases.

Joseph V. Kaplan, a Passman & Kaplan Founding Principal, will be a presenter at the American University's 8th Annual Key Executive Leadership Conference on May 17, 2017. Key Executive Leadership Programs is a part of American University's School of Public Affairs, where Mr. Kaplan is on the adjunct faculty. Mr Kaplan's topic is "The Whistleblower Protection Act: Updates and Insights."

Joseph V. Kaplan, a Passman & Kaplan Founding Principal, will be a presenter at the Society of Federal Employee and Labor Relations Professionals (SFLERP) 44th Symposium on May 18, 2017. Mr. Kaplan, a twice former National President of SFLERP will be speaking on the topic of Employee Privacy in a presentation entitled, "It's None of Your Business: A Guide to Employee Privacy Rights Regarding EEO Issues." 

News from the Federal Circuit: Part of DVA SES Discipline Law Struck Down

News from the Federal Circuit:  On May 9, 2017, the U.S. Court of Appeals for the Federal Circuit issued its decision in Helman v. Dept. of Veterans Affairs, No. 2015-3086.  The Court struck down part of the statute for expedited removals of Department of Veterans Affairs (DVA) Senior Executive Service (SES) employees as unconstitutional, but left much of the statute in place.

News from the White House: New DVA Whistleblower Office

News from the White House:  On May 2, 2017, the President issued Executive Order 13,793.  The Executive Order creates a new office at the Department of Veterans Affairs focusing on whistleblower reprisal and disciplinary issues.

Passman & Kaplan Senior Associate Johnathan P. Lloyd will be speaking on a panel at an American Bar Association conference in Washington, DC on May 19, 2017. The panel, "Federal Whistleblowing: When To Do It, How To Do It, And Protections Under The Law," is part of the 13th Annual Administrative Law and Regulatory Practice Institute, presented by the ABA's Section on Administrative Law and Regulatory Practice.
