Discrimination & EEOC Cases

Employment Discrimination Attorneys | Washington, D.C., Maryland & Virginia; Federal Employees Worldwide

Employment discrimination may occur subtly — getting passed over for a promotion or training, or discovering a significant disparity in awards — yet, over time, a pattern seems to emerge. You may notice that other members of minority groups or women are finding it difficult to advance within your department, or that certain people never seem to get hired for certain jobs.

If you suspect discrimination on the part of your federal agency or private sector employer, contact Passman & Kaplan, P.C., Attorneys at Law, in Washington, D.C.

P&K is committed to helping employees fight for workplace equality. We represent federal, state, municipal and private sector clients in Washington D.C., and Maryland, and handle cases for federal employees in Washington D.C., Maryland, Virginia, West Virginia, nationwide and worldwide.

What Constitutes Employment Discrimination?

Federal law makes it illegal to discriminate against a current employee or a job applicant in any way, including in hiring, firing, layoffs, terms of employment, ability to advance, or any work privilege based on:

  • Race
  • Color
  • National origin
  • Sex/gender
  • Pregnancy
  • Religion
  • Age
  • Disability or perceived disability
  • Participation in protected EEO activity
  • Sexual orientation (be executive order or under union contract)

Some state and local laws expand upon these protections to include discrimination based on sexual orientation or other factors of identity. Collective bargaining agreements or organizational policies can create additional contract rights to protection from discrimination in employment.

Helping Resolve Discrimination Complaints

Whether you are a government employee or work for a private enterprise, our attorneys can help. Together, we will review your employment discrimination allegation and make sure all necessary steps are taken as we pursue your case.

If you are a federal employee, we can represent you in the informal stages, including attempts at early settlement through mediation. If your case needs to "go formal," we can file your complaint and represent you in the EEO investigation and in the EEOC hearing before an administrative judge. In some cases, we may represent you in U.S. District Court, where your case may be decided by a federal judge or jury. We educate federal employees on the complaint procedures unique to those working within a federal agency.

If you are a private sector employee, our attorneys can begin by assisting you in filing a complaint with your employer. If your employer does not make an adequate attempt to resolve your complaint, we can help you file with the EEOC or the appropriate state or local government agency.

Because of the time-sensitive nature of filing such cases, our lawyers will keep in close contact with you to ensure timely and correct filing. We also handle whistleblower retaliation cases.
